A STUDY OF INSTITUTIONAL DETERMINATION AND CONSOLIDATION IN PUBLIC INTERNATIONAL LAW - THE CHAGOS CASE

Located in the middle of Indian Ocean, Chagos Archipelago has been subject to a sovereignty dispute between United Kingdom and its former colony, Mauritius. Before Mauritius gained independence 1968, was separated order establish British Ocean Territory. The main island archipelago, Diego Garcia, leased States is home military base with 3.000 personnel. challenging detachment Archipelago, which it claims be unlawful, by using international legal mechanisms available before it. After journey that involved International Court Justice (ICJ), Nations General Assembly (UNGA), Tribunal for Law Sea (ITLOS), achieved victory.
 ICJ’s Advisory Opinion determined Mauritius’s right self-determination within context decolonization violated ITLOS Special Chamber consolidated this finding acknowledging as sovereign Archipelago. While these decisions are admirable upholding self-determination, they have stretched jurisdictional limits each respective institution ruling on dispute.
